Under Rhode Island law, motorists can apply for a conditional hardship license. Whether it is a DUI for a refusal, the hardship allows a motorist to drive even when his or her license is under suspension. The motorist will be allowed to drive to work, doctor's appointments, school, and any other appointments that are court-approved..
A conditional hardship license does require a motorist to have an ignition interlock device installed in any alcohol related DUIs and refusals. A conditional hardship license is still available under Rhode Island law, even if your offense was related to drugs. In a drug case DUI, the ignition interlock device is similar to a breathalyzer and will not be able to detect drug use. Therefore unlike an alcohol case where the vehicle will not start, there is no mechanism to prevent the car from starting. In drug cases for a first offense, if the judge or magistrate has made a determination that the motorist was under the influence of drugs, but not alcohol, the judge or magistrate shall, immediately grant a conditional hardship license after a finding of need. However, this will be pursuant to proof of a negative blood and urine screens submitted by the motorist . The motorist will not need to have an ignition interlock installed, however will have to submit negative drug screens to the court. Hardship licenses are only available for certain offenses. Not every motorist charged with a DUI or Refusal to submit to a chemical test automatically gets a hardship. If a motorist is arrested for a first offense and there is no accident, then the judges must order a hardship after a finding of need. If there is an accident or the defendant has prior alcohol charges, the judge has the discretion to not issue a hardship license.
